These Terms of Service ("Terms") govern your access to and use of Frugger ("Service"), operated by SANC AG ("Company", "we", "us", or "our"), located at Binzstrasse 16, 8712 Switzerland, and our website at frugger.com ("Site"), along with our related websites, networks, applications, and other services provided by us (collectively, the "Service").

By clicking "I Accept" or using the Service, you agree to be bound by these Terms and our Privacy Policy. These Terms include a binding arbitration clause and a class action waiver. If you do not agree, do not use the Service.
1. Service Description
Frugger is a smart routing layer for LLM-based applications that optimizes costs while maintaining output quality by intelligently routing requests to the most cost-effective capable model.
Eligibility
You may use the Service only if:
- You are at least 18 years old
- You have the legal authority to accept these Terms
- You are not barred from using the Service under applicable law
License Grant
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to use the Service for your internal business or personal use.
2. Account Terms and Security
To access the Service, you must create an account. You agree to:
- Provide accurate and complete registration information
- Maintain the confidentiality of your credentials
- Promptly notify us of any unauthorized access
- Remain responsible for all activities under your account
API Key Security
- Keep your API keys secure and confidential
- Do not share API keys with unauthorized parties
- Rotate API keys immediately if compromised
- You are responsible for all API usage under your keys
3. Pricing and Payment
The Service currently offers:
- 100 free re-routed requests
- Unlimited non-re-routed requests for free
- A 30% fee on cost savings from re-routed requests beyond the free tier
Payment Terms
- Payments are processed via Stripe
- All fees are exclusive of taxes
- You agree to pay all applicable taxes and fees
- Fees are non-refundable unless required by law
Billing
- Usage is billed monthly in arrears
- We may suspend or terminate your access for non-payment
- You are responsible for maintaining valid and current payment information
Savings Fee Calculation
The 30% fee applies to the difference between the baseline model cost and the re-routed model cost, as determined by our system.
4. API Usage and Limitations
API Rate Limits
- Default rate limits apply to all endpoints
- Rate limits are based on requests per minute and tokens per minute
- Higher limits may be available to enterprise customers
- We reserve the right to adjust rate limits at any time
Model Availability
- Model availability may vary depending on third-party provider status
- We do not guarantee availability of specific models
- Models may be added or removed without notice
- Fallback models may be used when applicable
API Usage Requirements
- Use only valid API keys in requests
- Implement proper error handling in your applications
- Follow best practices for retries and timeouts
- Monitor your usage and stay within rate limits
Third-Party Policies
You must comply with the terms and acceptable use policies of third-party model providers accessed through the Service.
5. User Obligations
Prohibited Uses
You agree not to:
- Use the Service for any unlawful or unauthorized purpose
- Bypass or manipulate the Service's features, rate limits, or billing mechanisms
- Generate content that is illegal, harmful, or discriminatory
- Interfere with the operation or integrity of the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service to send spam or unsolicited messages
- Impersonate another person or misrepresent your identity
Your Responsibilities
- Comply with all applicable laws and regulations
- Respect API usage guidelines and limits
- Maintain adequate security practices
- Report any security incidents or vulnerabilities
- Keep your contact and billing information current
Content Guidelines
- You are responsible for all content generated through the Service
- Content must comply with our Acceptable Use Policy
- We reserve the right to monitor and remove content that violates our policies
- You retain all rights to your content but grant us a license to use it as needed to provide and improve the Service
6. Service Modifications and Availability
Service Changes
- We may modify, suspend, or discontinue parts or all of the Service at any time
- We will provide reasonable notice of material changes where possible
- Continued use of the Service constitutes acceptance of the modified Terms
Service Availability
- We aim for high availability but do not guarantee uninterrupted service
- Maintenance may be scheduled with or without notice
- We are not liable for downtime, delays, or interruptions
7. Termination and Suspension
Termination by Us
We may suspend or terminate your account if:
- You violate these Terms
- You engage in prohibited activities
- You fail to pay any owed fees
- We determine, in our sole discretion, that termination is necessary (with reasonable notice)
Termination by You
You may terminate your account at any time by contacting us.
Effect of Termination
- Your access to the Service will be revoked
- Your data will be handled according to our Privacy Policy
- All outstanding payments remain due
- All licenses granted will terminate
We may delete your data within 30 days unless otherwise required by law. You may request a data export prior to account termination.
8. Warranties and Liability
Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
We do not warrant that:
- The Service will be secure or available at any particular time or location
- Any defects or errors will be corrected
- The results of using the Service will meet your requirements
Limitation of Liability
To the maximum extent permitted by law, we are not liable for:
- Service interruptions or downtime
- Data loss or corruption
- Indirect, incidental, or consequential damages
- Performance or availability of third-party models
- Any damages exceeding the amount you paid us in the past 12 months
9. Dispute Resolution
Arbitration Agreement
You agree that any dispute or claim arising from or related to these Terms or the Service will be resolved through binding arbitration in Switzerland, under the rules of the Swiss Chambers' Arbitration Institution. You waive your right to bring disputes in court.
Governing Law
These Terms are governed by and construed in accordance with the laws of Switzerland, without regard to conflict of law principles.
Class Action Waiver
You agree to resolve disputes on an individual basis and not as part of a class, consolidated, or representative action.
10. Intellectual Property
Our Rights
- We own all rights, title, and interest in and to the Service, including all intellectual property
- Our trademarks, logos, and branding may not be used without our written consent
Your Content
- You retain ownership of content submitted through the Service
- You grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, and display your content to operate and improve the Service
11. Data Protection and Privacy
We process personal data in accordance with our Privacy Policy. If you are subject to the General Data Protection Regulation (GDPR), you may have additional rights, including the right to access, correct, or delete your data.
12. Force Majeure
We are not responsible for any delay or failure in performance resulting from causes beyond our reasonable control, including acts of God, war, terrorism, labor disputes, or technical failures.
